Reilly Pozner LLP Wins the Relativity Innovation Award for “Best Law Firm Solution”

Scott Shadler, IT Director at Reilly Pozner LLP, designed a Damages Calculator module which is part of the Case Assessment Calculator application for Relativity which extends the platform to enable real-time assessments of client-level data that has been entered into Relativity.  This Case Assessment Calculator application is used by Reilly Pozner LLP as a single repository of client case information and data.  It provides the end user with client-level data capture, support and management.  It also allows for real-time projections and forecasts of portfolio values.  When asked about the practical use of the Case Assessment Calculator application Shadler said, “The Relativity platform has allowed Reilly Pozner to create a flexible, real-time tool to manage and assess the potential value of its varied mass tort portfolio.”

kCura, developers of the e-discovery software Relativity, announced winners during a special ceremony at Relativity Fest, held October 11-14 in Chicago. The annual user conference brought more than 1,500 users together for a three-day event featuring engaging panel discussions, hands-on labs, breakout sessions, and insights from both kCura staff and Relativity end users.

Gov. John Hickenlooper asked the Colorado Supreme Court on Wednesday to rule that he, not the state’s attorney general, has the final say on whether to sue the federal government.

Hickenlooper’s petition comes after he complained that Attorney General Cynthia Coffman should not have joined about two dozen other states in suing the Environmental Protection Agency over new air pollution rules without his authorization.

Coffman said the rules are an illegal overreach. The governor supports the rules and is trying to implement them.

Governor Hickenlooper’s Press Release on Lawsuit Filed Against Colorado Attorney General

DENVER — Wednesday, Nov. 4, 2015 — Gov. John Hickenlooper today filed a petition asking the Colorado Supreme Court to issue a legal rule that the governor, not the attorney general, has the ultimate authority to decide on behalf of the state when to sue the federal government in federal court.

“The attorney general has filed an unprecedented number of lawsuits without support of or collaboration with her clients,” said Jacki Cooper Melmed, chief legal counsel to the governor. “This raises serious questions about the use of state dollars and the attorney-client relationship between the governor, state agencies and the attorney general.”

The petition states “The Governor’s disagreement with the Attorney General’s filings is not based on the legal merits of the federal lawsuits; it is about the direction of Colorado [executive department] policy, which is he is empowered to direct under our constitution and laws.”

James E. Fogg Joins Reilly Pozner LLP

Reilly Pozner LLP is pleased to announce that James E. Fogg joined the firm as an associate attorney.

Jim recently completed a judicial clerkship with the Hon. James S. Casebolt of the Colorado Court of Appeals. During law school, he was a law clerk to Reilly Pozner LLP and Holland and Hart LLP.   Jim also served as a student attorney with the Environmental Law Clinic of the Sturm College of Law Student Law Office: In that capacity served as the lead attorney in an APA case. The law clinic presented him with the Superior Leadership Award.

Jim is a 2014 graduate of the University of Denver Sturm College of Law and was named to the Order of Saint Ives (top 3% of the graduating class). He received a merit based scholarship and was an articles editor for the University of Denver Water Law Review. Jim participated in a number of mock trial competitions and was a member of the National Trial Team, a Hoffman Cup semi-finalist and a Champion of the Hogan Lovells CU/DU Tournament. He earned his undergraduate degree from the University of Colorado and graduated magna cum laude with dual degrees in Political Science and Environmental Studies.

Michael Kotlarczyk Named a Partner of Reilly Pozner LLP

Reilly Pozner LLP is proud to announce that Michael Kotlarczyk has been elevated to partner effective immediately.

Mike joined the firm in 2010 as an associate attorney. He focuses his practice on civil and commercial litigation. He has worked on a variety of matters at the firm including high stakes litigation in the financial industry for prominent companies like the American International Group (AIG) and on claims brought by former players and insurance companies against the Denver Broncos Football Club.

Before entering private practice, Mike served as judicial clerk to both the Hon. David Ebel of the U.S. Court of Appeals for the Tenth Circuit and the Hon. Rebecca Pallmeyer of the U.S. District Court for the Northern District of Illinois.

Mike graduated in the top five percent of his class from Georgetown University Law Center, where he was a Dean’s Scholar (a full-tuition merit based scholarship). He served as managing editor of The Georgetown Law Journal’s highly acclaimed Annual Review of Criminal Procedure. In his final year, he covered the U.S. Supreme Court as an intern for CQ Press.

Reilly Pozner Case Discussed in Law360 Article Titled “Judge Hits OPM With Latest Class Action Over Data Breaches”

The U.S. Office of Personnel Management failed to address deficiencies in its security systems and thus allowed hackers to steal the personal information of millions of current, former and potential government workers, according to an administrative law judge’s proposed class action filed Friday in Colorado federal court.

Social Security Administration Judge Teresa J. McGarry’s suit is the latest proposed class action triggered by two recently announced data breaches that compromised more than 22 million applicants’ personnel and security files, alleging that OPM failed for years to correct cybersecurity weaknesses identified by Office of Inspector General audits.

“Since at least 2007, OPM has been on notice of significant deficiencies in its cyber security protocol,” the complaint said. “OPM not only failed to cure the weaknesses, but OIG found that in many areas OPM’s performance actually got worse.”
