About Anthony:
Tony focuses his practice on complex commercial litigation, including multi-state class and mass actions. He has lectured on the Class Action Fairness Act of 2005, which expanded federal jurisdiction over many large class action lawsuits and other multiparty claims. He also represents plaintiffs in catastrophic personal injury litigation. Tony plays an important role in these cases: In a medical device mass tort action, thousands of plaintiffs are pursuing personal injury damages claims resulting from the failure of metal-on-metal hip implant devices such as the DePuy ASR, DePuy Pinnacle and Zimmer Durom Cup. Clinical studies suggest a greater-than-average failure rate and other serious health injuries associated with such metal-on-metal devices. Injured claimants from around the country have turned to Reilly Pozner for representation. In a pharmaceutical mass tort action, thousands of plaintiffs are pursuing personal injury claims against GlaxoSmithKline, which manufactures Avandia® —a drug for the treatment of Type-2 diabetes. In several clinical studies, Avandia has been shown to increase the risk of heart attack, congestive heart failure and other cardiovascular-related events. Reilly Pozner negotiated a landmark settlement for thousands of Avandia claimants. When a group of automobile dealerships face a purported class action claiming that new cars were equipped in violation of the Colorado Consumer Protection Act and hired Reilly Pozner to defend its interests. After winning landmark reversals at the Colorado Court of Appeals and Supreme Court of the trial court’s initial approval of class treatment, the firm defeated Plaintiffs’ second attempt at class certification in the trial court. When The Variable Annuity Life Insurance Company (VALIC) noticed that its financial advisers were being aggressively recruited by the competition in what looked like coordinated hiring campaigns, VALIC retained Reilly Pozner as national counsel to protect its trade secrets and enforce its non-competition agreements in more than 20 cases in courts around the country. Through the firm’s skillful use of temporary restraining orders and preliminary injunctions, VALIC has achieved some significant settlements and verdicts, and has seen a significant decrease in unfair competition by its former employees. Tony has also:
“When Reilly Pozner is engaged in series of similar cases in multiple states, it is very important that we not take a position in one case that might negatively affect the others. Each individual case must stand on its own, but also fit into the big picture. That is one of the roles of a case manager – a role I often serve.”
