Bankruptcy Litigation

Reilly Pozner's bankruptcy litigation practice grew out of its representation of Lehman Brothers Holdings Inc (LBHI). Since 2006, the firm has prosecuted claims for Lehman and its subsidiary Aurora Loan Services against counterparties who originated and sold defective loans to Lehman on the secondary market. When LBHI filed for Chapter 11 protection, the bankruptcy court appointed RP as special counsel to LBHI to continue with this nationwide loss recovery effort. Not surprisingly, our pursuit of mortgage loan originators often requires the firm to litigate in those defendants' bankruptcy proceedings, as a creditor. Our ability to stay on target for our clients even where an opponent filed for bankruptcy is an important component of our complex litigation practice.
