Victory in Denver Broncos NFL Football Franchise State Court Appeal
RP is pleased to announce its most recent win in the ongoing litigation involving the Denver Broncos NFL football franchise.
This case involves Edgar F. Kaiser, Jr.’s incorrect interpretation of a right of first refusal provision in a 1984 sales agreement by which Pat Bowlen purchased from Kaiser a majority interest in the partnership owning the Denver Broncos NFL football franchise. Bowlen and his family later acquired the remaining interests in the Denver Broncos franchise. Kaiser filed two lawsuits in both federal and state courts against RP’s clients, Bowlen, his family, and entities owning the Denver Broncos franchise (the “Bowlen Defendants”). RP represented the Bowlen Defendants when Kaiser lost the federal case in the United States Court of Appeals for the Tenth Circuit. After Kaiser’s defeat in the Tenth Circuit, the state court granted summary judgment in favor of the Bowlen Defendants, agreeing with RP’s lawyers that issue preclusion barred Kaiser from pursuing his claims again in state court after already losing in federal court. Kaiser appealed that decision.
The Colorado Court of Appeals, in an opinion announced October 2, 2008, affirmed the district court’s granting of summary judgment in favor of the Bowlen defendants.
