Anthony L. Giacomini

Partner

Tony focuses his practice on complex commercial litigation-especially multi-state class and mass actions. He has lectured on the Class Action Fairness Act of 2005, which expanded federal jurisdiction over many large class action lawsuits and mass actions. He also represents plaintiffs in construction defect and personal injury litigation.

Tony played an important role in these cases:

When The Variable Annuity Life Insurance Company (VALIC) noticed that its financial advisers were being aggressively recruited by the competition in what looked like coordinated hiring campaigns, VALIC retained Reilly Pozner as national counsel to protect its trade secrets and enforce its non-competition agreements in more than 20 cases in courts around the country. Through the firm's skillful use of temporary restraining orders and preliminary injunctions, VALIC has achieved some significant settlements and verdicts, and has seen a significant decrease in unfair competition by its former employees. Tony has served as the firm's managing attorney for all of these cases nationwide.

When individuals and businesses in seven states suffered monetary losses and inconvenience as a result of delayed telephone phone line installation by U.S. West (now Qwest), they turned to the lawyers of Reilly Pozner for representation in a series of seven state consumer class actions. The firm's "held order" litigation over four years resulted in seven successful settlements to the tune of $120 million. Tony was a member of this trial team.

Tony has also:

• Defended a major life insurance company in a certified nationwide consumer class action in the state of New Mexico relating to modal premium payments. Tony was responsible for brief writing, fact development, witness preparation and demonstrative evidence design. He was also involved in the appeal of the class certification decision to the New Mexico Court of Appeals.

• Represented seven state insurance guarantee associations and hundreds of individual investors in a series of multi-state consumer fraud cases against a regional stock brokerage firm. He prepared for and attended nearly 200 depositions, designed demonstrative exhibits, prepared witnesses for trial testimony, and assisted with voir dire and trial presentation in four jury trials.

“When Reilly Pozner is engaged in series of similar cases in multiple states, it is very important that we not take a position in one case that might negatively affect the others.  Each individual case must stand on its own, but also fit into the big picture.  That is one of the roles of a case manager – a role I often serve.”
