Wins Decertification of Class Action

 

 

RP is pleased to announce its most recent win in the ongoing litigation involving the Medved Colorado automobile dealerships.

RP is defending Medved Chevrolet and other Medved dealerships in a case involving a purported class action in which the Plaintiff claims that the new cars on the dealer’s lots were equipped with dealer-added products in supposed violation of the Colorado Consumer Protection Act.  The dealerships hired Reilly Pozner to defend their interests.

The case has been in discovery for class certification purposes, and it was certified for class action status earlier this year.  In a recent interlocutory appeal to the Colorado Court of Appeals, however, the trial court’s certification was reversed.  Specifically, the Court of Appeals disallowed the trial court’s application of a presumption of causation in consumer class actions.
